Terms of Use

1. About the Service

Kelner App("the Platform") is a personal software project developed and maintained by a private individual located in Poland, for the sole purposes of:

• Demonstrating software development skills (portfolio)
• Educational and experimental use
• Allowing interested parties to test POS-like functionality for food businesses

The Platform is:

• 100% free — no fees, subscriptions, premium tiers, or payments of any kind, now or in the future while in demo mode
• Non-commercial — generates zero revenue; no goods or services are sold
• Experimental — provided "as is" without any warranties

2. No Business Entity

The Platform is operated by a private individual (natural person). It is not associated with any registered company, sole proprietorship (JDG), foundation, or other legal entity. Specifically:

• No payments are collected from users — the Platform has no payment gateway, billing, or invoicing
• No commercial services are offered or sold
• No business contracts are formed between the operator and users
• No revenue, donations, or funding of any kind is generated
• No advertising is displayed

3. Demo and Testing Use Only

The Platform is intended exclusively for demonstration and testing purposes. By using it, you acknowledge and accept that:

• You should use fictitious or test data only — do not enter real customer names, phone numbers, or sensitive information
• You should not rely on this Platform for real business operations
• All data (accounts, content, configurations) may be deleted at any time without prior notice, for any reason, including system maintenance, database resets, or project restructuring
• Features may change, break, or be removed without warning

4. What You Can Do on the Platform

The Platform allows you to:

• Create an account using your email address and sign in via a one-time code (OTP)
• Create and manage a demo "place" (restaurant, café, etc.) with menu items, categories, and images
• Generate a demo website with a custom subdomain and a choice of templates
• Test order management, table management, reservations, kitchen display, queue numbers, and payment recording workflows
• Invite other users to collaborate on a demo place
• Translate menu content into multiple languages

All of the above is provided free of charge and solely for demonstration purposes.

5. User-Generated Content

You retain ownership of any content you create on the Platform (menu items, images, descriptions, etc.). However:

• You grant the operator a non-exclusive right to store and display your content as necessary for the Platform to function
• You are solely responsible for ensuring your content does not violate any laws or third-party rights
• The operator may delete any content at any time, for any reason

6. User Responsibilities

By using the Platform, you agree to:

• Use the Platform only for lawful purposes
• Not upload illegal, offensive, defamatory, or infringing content
• Not attempt to exploit, hack, or disrupt the Platform or its infrastructure
• Not use the Platform to process real personal data of third parties (e.g., real customer information)
• Accept the demo nature and all associated risks

7. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. The operator:

• Does not guarantee uptime, availability, or performance
• Does not guarantee data preservation, integrity, or backup
• Is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform
• Is not liable for any data loss, including but not limited to account data, menu content, or configurations
• May terminate, suspend, or modify the Platform at any time without prior notice

To the maximum extent permitted by applicable law, the operator's total liability is limited to zero (0), as this is a free, non-commercial service.

8. Account Termination

You may delete your account at any time from your Profile settings. The operator may also suspend or delete accounts that violate these Terms or for any operational reason.

9. Intellectual Property

The Platform's source code, design, and branding (including the name "Kelner App") are the intellectual property of the operator. These Terms do not grant you any rights to use the operator's intellectual property beyond normal use of the Platform.

10. Changes to These Terms

These Terms may be updated at any time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved by the courts of competent jurisdiction in Poland.
